She was admitted as an attorney in 1999, subsequently as a conveyancer and has right of appearance to practice in the High Court.
In her years as an attorney she has been exposed to various fields of the law which includes amongst others: Commercial law; contract law; labour law, personal injury law; telecommunications law; mining law; litigation in both the High court and Magistrate’s Courts; compliance and regulatory issues.
Her commercial exposure and experience entails: The drafting of agreements, attending to review various agreements on behalf of clients, giving advice on the aforesaid agreements and assisting in the redrafting of the agreements where necessary, assisted a number of clients in formulating policies and the drafting thereof; advising clients on all aspects of the Companies Act. She has gained considerable experience in mergers and acquisition transactions and also has exposure to compliance and regulatory issues.
Whilst employed by a firm which was on the SABC panel of attorneys, she gained considerable exposure to compliance and regulatory issues and has appeared before ICASA and the Independent Complaints Board on behalf of the SABC. She was part of the team which drafted the licence conditions for the SABC. She has a limited exposure to litigious matters in Intellectual Property Law, where copyright infringement and dispute relating to patents were always at issue. She also gave advice to the SABC on issues of ownership of rights and drafted clauses in the SABC agreements regulating intellectual property rights.
She has been exposed to different facets of labour law and has mainly given advice to clients on S198 transactions, i.e. the transferability of employees in mergers and acquisition transactions. She has drafted labour policies i.e. disciplinary procedure manuals, grievance procedures, the drafting of independent contractor agreements and the drafting of employment contracts. She has also reviewed and given advice on the aforementioned agreements and policies. Ms Sefanyetso has also provided training on disciplinary procedures and conducting of hearings, for a number of clients, which includes, Metrorail, a business division of Transnet Limited. She has also litigated in the Labour Court on numerous occasions.
Transactions involved in: - the corporatisation of the former Metrorail, Transwerk and Autonet, gave advice to NECSA (formerly AEC) on certain provisions of the Companies Act, whilst considering its corporatisation, assisting a consortia in acquiring a 25% stake in AVI Limited, the holding company of I & J Limited; advising a company bidding for the acquisition of Irenco Limited, a division of Denel and acting as advisor to the Masebe Community (Limpopo) in relation to their joint venture transaction with the Limpopo Parks Board, where she also gained insight into mining issues.
Litigation experience: Acted for the Road Accident Fund on personal injury claims, collections and recoveries for various clients, ranging from arrear rental collections on behalf of Transnet Property, to motor recoveries for Alexander Forbes Insurance. She has acted for corporate clients such as - the Council for Geoscience and the Gauteng Gambling Board on litigious matters.
